APPLICATION OF SALES TERMS

1. These Sales Terms and Conditions apply to the purchase of goods and services between the customer of the Sisustuspood.ee online store (hereinafter “the Consumer”) and Arem Kaubandus OÜ (hereinafter the “Online Store” or “Sisustuspood.ee”).

2. In addition to these terms, legal relations arising from the purchase of products from the Online Store are governed by the Law of Obligations Act, the Consumer Protection Act, and other legislation in force in the Republic of Estonia.

3. The Online Store reserves the right to amend the Sales Terms and Conditions. Amendments are published on the Sisustuspood.ee website.

PRICING INFORMATION

1. Prices are valid from the time the order is placed until the payment deadline expires (five days after placing the order).

2. Where an order is placed before amendments are made to prices or terms, the legal relationship between the Consumer and Sisustuspood.ee are subject to the terms valid at the time of ordering.

3. The Online Store reserves the right to amend prices. Amendments are published on the Sisustuspood.ee website.

PLACING AN ORDER

1. Add the desired products to the shopping cart.

2. Click on “Checkout” in the shopping cart.

3. Choose whether to place the order as a guest or as a registered customer.

4. Complete the required fields and click on “Place Order”. An invoice will be displayed that you can conveniently pay via the bank link or with a credit card. You will find the details for making a euro payment, inclusive of all applicable national taxes and surcharges, on the invoice that will be displayed once the order has been confirmed.

5. Carefully verify the data you have entered in the details and the order confirmation page, as the quick and smooth delivery of your purchased goods, (as well as the handling of any disputes and complaints, ) depends on the accuracy of the information you submit.

6. Order confirmations are sent automatically by email. Online Store orders are processed from 8:00-17:00 Monday-Friday. Orders placed after 14:00 on a Friday are processed the following Monday.

ENTRY INTO FORCE OF THE SALES CONTRACT

1. Under the sales contract for the goods, the Online Store agrees to deliver to the Consumer the goods, whether in stock, in progress or to be procured by Sisustuspood.ee in the future, and to enable the transfer of ownership to the Consumer, while the Consumer agrees to pay the Online Store the amount indicated on the invoice for the goods and to accept the goods.

2. Unpaid orders are cancelled after five days.

3. The sales contract enters into force upon receipt of the payment from the Consumer in the bank account of the Online Store.

DELIVERY

1. After the entry into force of the sales contract, the Online Store prepares the order and hands it over to logistics partners for delivery.

2. Delivery times indicated on the Online Store website apply from receipt of payment in the Online Store bank account.

3. To avoid delivery delays, the Consumer should exercise care and enter accurate delivery details when placing the order.

4. The Online Store is not liable for delays if the goods have been handed over to the logistic partners and the delivery delays are due to circumstances beyond the control of the Online Store.

RIGHT OF RETURN

1. After receiving the ordered goods, the Consumer has the right to withdraw from the contract made in the Online Store within 14 days without having to provide a reason.

2. An order cannot be cancelled if the goods are custom-made according to the client’s individual specifications, such as dimensions. Kitchen furniture and kitchen sinks are always made to the dimensions and colour scheme selected by the client. 

3. The Consumer is liable for any diminished value of returned goods only if the Consumer has used the item in a manner other than that which is necessary to ascertain the nature, features and functioning of the item. In order to ascertain the nature, features and functioning of the item, the Consumer should handle and use the item only in the manner that they would normally be allowed to do in a store.

4. To return goods, the Consumer must complete a withdrawal notice and send it to info@sisustuspood.ee or to the postal address within 14 days of receipt of the goods.

5. The Consumer must return the goods within 14 days of the withdrawal notice or prove that they have handed the goods over to a logistics company by the same deadline.

6. The customer need not use the services of a logistics company to return the goods if the Online Store has agreed to collect the goods itself.

7. Upon receipt of the withdrawal notice, the Online Store refunds the entire amount received from the Consumer under the contract, including the delivery costs, without delay, but no later than within 14 days.

FORCE MAJEURE
The Online Store is not liable for delivery delays or damages to the goods caused by circumstances that the Online Store could not control or foresee.

PROCESSING OF PERSONAL DATA

1. When entering data in the Online Store and by giving their relevant confirmation, the Consumer grants the right for the collection and processing of their personal data (name, phone, delivery and/or home address, email) and for sharing their personal data with a logistics partner for the delivery of the goods.

2. The Consumer may prohibit the collection and use of their personal data at any time, unless the data is necessary to collect contractual claims or to deliver goods.

3. Encrypted data communication with banks when paying for purchases ensures the safety of the Consumer’s personal banking verification details. The Online Store has no access to such details.

CLAIMS PROCEDURE

1. The Online Store is liable for any non-conformity or defect of the goods sold to the buyer under the terms of the contract, provided that the non-conformity or defect existed at the time of delivery of the goods and becomes apparent within two years of the delivery of the goods to the buyer. During the first six months from the delivery of the goods to the buyer, it is assumed that the defect already existed at the time of delivery of the goods. The burden of rebutting this assumption lies with the Online Store. If a defect becomes evident, the buyer has the right to contact the Online Store within two months by sending an e-mail to info@sisustuspood.ee or by calling 433 3803.

2. Please discontinue using the goods when a defect appears.

3. The repair or replacement of defective goods will be agreed upon between the Online Store and the Consumer. The repair costs will be covered by the Online Store.

4. The Online Store is not liable for any defects in the product that have arisen due to the fault of the Consumer as a result of improper storage of the product or use of the product for purposes other than its intended purpose.

5. If the product does not meet the requirements or has any defects, please email a complaint to info@sisustuspood.ee, stating the name of the person who placed the order, their contact telephone number, the order number and a precise description of the product’s defect or non-conformity.

6. Complaints about con-conformities or defects must be submitted within two months of discovering the non-conformity or defect.

7. All claims will be reviewed and the Consumer will be contacted as soon as possible, but no later than within 14 days of the receipt of the complaint.

8. The Consumer has the right to demand that the Online Store reduce the purchase price or terminate the contract and refund the cost of the goods if the Online Store is unable to repair or replace the goods, the repair or replacement of the goods fails, the Online Store does not eliminated the defect in the goods within a reasonable time, or unjustified inconvenience has been caused to the Consumer.

DISPUTE RESOLUTION

1. If the buyer has any complaints regarding the Online Store, they should be sent by email to info@sisustuspood.ee or communicated over the phone on 433 3803.

If the buyer and Sisustuspood.ee are unable to resolve the dispute by way of agreement, the buyer may contact the Consumer Disputes Committee. You can read the procedural terms for doing so and submit an application here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract between the buyer and the Online Store. The reviewing of the buyer’s complaint by the Committee is free of charge. The buyer may also contact the consumer dispute resolution platform of the European Union.
